Public Offer to Passengers of SK VTB Insurance Ltd. to Take out Contracts of Insurance

This public offer (the "Offer") is an offer made to a broad range of individuals by SK VTB Insurance Ltd. (SK VTB Insurance Ltd.) (the "Insurer") to take out a passenger insurance policy for the tip period as defined in an issued electronic ticket (the "e-ticket") (the "Contract of Insurance" or the "Insurance Policy") subject to the terms and conditions set out in the Special Insurance Terms and Conditions (the "Special Terms and Conditions").

This insurance is voluntary and it is your optional right whether to take out this Contract of Insurance and pay an insurance premium or not. The taking out of a contract of insurance is not mandatory for getting an e-ticket.

Pursuant to Article 438 of the Civil Code of the Russian Federation, the full and unconditional acceptance of the terms and conditions of this Offer by an individual will be as the positive mark "☑" on the page from across the statement "I hereby acknowledge that I have read and understood the rules and procedures for placing an order, making a payment, booking and re-booking a travel certificate (ticket), returning an unused travel certificate (ticket) that has been booked via Internet and issued I also hereby acknowledge that I have read and understood Insurer's Special Terms and Conditions for an insurance policy and the terms and conditions of the Offer at JSC RZHD's official web portal (http://www.rzd.ru) and I have paid the insurance premium payment as required by the Contract of Insurance (Insurance Policy). Performing the aforesaid acts means that an individual has accepted all the terms and conditions of this Offer, the terms and conditions of the Contract of Insurance, and the Special Insurance Terms and Conditions, and it has entered into a Contract of Insurance (Insurance Policy) in writing.

You, as a user of JSC RZHD's official web portal and potential Policyholder, confirm your right, legal capacity, and financial solvency, and that you are aware of the liabilities assumed by you as a result of accepting this Offer.

An insurance application is filed by entering at JSC RZHD's official web portal personal data of individuals who are to be insured under an insurance policy, and by making the positive mark "☑" on the page from across the statement "I hereby acknowledge that I have read and understood the rules and procedures for placing an order, making a payment, booking and re-booking a travel certificate (ticket), returning an unused travel certificate (ticket) that has been booked via Internet and issued. I also hereby acknowledge that I have read and understood the Special Insurance Terms and Conditions for the Insurance Policy and the Terms and Conditions of the Offer which is the basis for the potential policyholder to give its consent and secure the consent of insured persons to

  • the terms and conditions of the Offer;
  • the Insurer's Insurance terms and conditions;
  • to process personal data specified by the policyholder upon issue of an e-ticket, by the Insurer and Insurer's representative – Federal Passenger Company Joint Stock Company, including collect, classify, acquire, store, update, use, depersonalize, block, destruct (without a notice of destruction) by automated or non-automated methods for the purpose of carrying out insurance activities for a 5-year period, performing a contract of insurance and allowing third parties to exercise internal document control.

The insurer undertakes to maintain the integrity and confidentiality of personal data of the Insured and the other individuals specified in the Contract of Insurance (Insurance Policy) as required by Federal Law No. 152-FZ On Personal Data".

Public Offer Terms and Conditions

1. Terms and conditions

The Insurer will be SK VTB Insurance Ltd. (SK VTB Insurance Ltd.) carrying out insurance activities in accordance with the laws and regulations of the Russian Federation and License SL No. 3398 dated September 17.09.2015 issued by the Bank of Russia (for an indefinite term).

Any capable individual who has taken out a contract of insurance from the Insurer in addition to a procured electronic travel certificate (ticket) in his/her favor or in favor or third parties (Insured persons) will be deemed to a Policyholder.

A Policyholder who has entered into a contract of insurance for its property interests will be an Insured.

The Insured as defined in this insurance as an individual who travels by rail as a passenger on the basis of an electronic travel document (ticket) and insured for his/her life and limb under a contract of insurance.

An insurance policy will be a document certifying that the Policyholder and the Insurer have entered into a Contract of Insurance for those departing outside one's permanent place of residence in the manner stipulated in this Offer and the Insurer's Special Insurance Terms and Conditions.

The parties to the Contract of Insurance (insurance policy) will be the Policyholder and the Insurer who have entered into the Contract of Insurance (insurance policy).

2. Taking out, Payment and Cancellation (Termination) of the Contract of Insurance (Insurance Policy)

2.1. Taking out of and Giving Effect to the Contract of Insurance (Insurance Policy)

2.1.1. The positive mark "☑" in the field "Taking out an insurance policy" at JSC RZHD's official web portal will be deemed to be the same as an Application to Take out a Contract of Insurance (Insurance Policy).

2.1.2. A Contract of Insurance (Insurance Policy) will be drafted by the Policyholder at JSC RZHD's web portal and accessible through the User Profile at JSC RZHD's web portal.

2.1.3. The parties to the Contract of Insurance (Insurance Policy) acknowledge their agreement that the payment of an insurance premium to the Insurer or the Insurer's representative (including JSC FPK) under the contract of insurance (policy insurance) – on the one hand, and the signing of the Contract of Insurance (insurance policy) by the Insurer using a faxed signature image of the Insurer's authorized representative and the Insurer's seal – on the other hand, will constitute the proper signing of the Contract of Insurance (insurance policy).

However, the Insurer and the Policyholder will agree to reproduce the Contract of Insurance (insurance policy) in printed form whenever such need arises.

2.1.4. The parties acknowledge their agreement that the delivery of the Insurance Policy to the User Profile of the Insured at JSC RZHD's web portal will be duly service of the Contract of Insurance (insurance policy) to the Insured. Payment by the Policyholder of an insurance premium in the manner consistent with the terms and conditions of the duly executed contract of insurance (insurance policy) will also serve as an acknowledged consent of the Policyholder to obtain a contract of insurance (insurance policy) in the aforesaid order and consent to the terms and conditions of the Contract of Insurance (insurance policy) and this Offer.

2.1.5. The Policyholder who has stated that the Insurance Contract (insurance policy) has been made will act on behalf of all stated Insured Persons, whereby all Insured Persons will be deemed to be informed of the terms and conditions of the contract of insurance (insurance policy), the Special Insurance Terms, and Conditions and the terms and conditions of this Offer.

2.1.6. A Contract of Insurance (insurance policy) will be deemed to be taken out on the date of the Policyholder's payment of an insurance premium in the required amount and will be effective for the period specified by the Insurer's Special Insurance Terms and Conditions. The insurance coverage under the Contract of Insurance (insurance policy) will be effective in the manner and within the time specified by the Insurer's Special Insurance Terms and Conditions.

2.2. Payments under Contracts of Insurance (Insurance Policy)

2.2.1. Payments of insurance contracts of insurance (insurance policy) will be made by wire transfer as required by article 3 of Federal Law No. 161 FZ On the National Payment System dated June 27, 2011 using Visa, Visa Electron, MasterCard, Maestro cards in operation with international payment systems as well as Visa International and MasterCard International. Payment by bank card will be made after checking and acknowledging the order followed by redirection to the VTB 24 (PJSC) payment gateway. The Policyholder will be allowed 10 minutes to decide whether to pay for the order and enter the details of its bank card. If the allocated time is exceeded, the insurance policy will be canceled.

To pay for an order, the following bank card details will require to be entered: the first and last name of the bank card holder, the bank card number and validity period, as well as a three-digit code (CVV2 or CVC2).

For further information on the specifics of payment by bank card of the Policyholder via Internet, any reasons for refusal to pay to the Policyholder, one should first of all to contact the support service of the Policyholder's bank.

The security of the payment procedure will be ensured by traffic encryption (SSL).

Payment by Visa Electron and Maestro:

Dear Policyholders, please make sure that your card carries the code CVV2 (CVC2) on the reverse side. Attention of holders of foreign card issuers! International payment systems require the 3D Secure / Secure Code technology (a dedicated solution for Internet payment security) to be used to enhance payment security. Unless your bank is properly certified to apply this technology, the payment system may deny processing your payment. In this case you should contract the support services of your bank.

With the 3D Secure / Secure Code technology, the Issuing Bank may require the Card Holder to submit to additional identification once the order is paid for.

The need for additional identification and its method will be decided on solely by the Issuing Bank. For more information on the identification procedure, the Card Holder should contact the support service of the bank that has issued the card.

If for any reason you have failed to receive the order number or the Insurance Contract (insurance policy), or confirmation of a successfully generated order, please go to the "My Orders" section and make sure that the order has not been effectively generated before you place another order.

If any disputes arise concerning debits from your account when you pay for the Contract of Insurance (insurance policy), you should contact VTB 24 (PAO) by phone at 8-800-100-24-24, and also the issuing bank where you are listed as a card holder.

2.3. Early termination (cancellation) of the contract of insurance (insurance policy) for the convenience of the Policyholder; insurance premium refund.

According to the terms and conditions of the Contract of Insurance, the policyholder may cancel the Contract of Insurance at any time.

2.3.1. The Policyholder may, for its convenience, early terminate (cancel) the Contract of Insurance (insurance policy), but not later than one (1) hour before the departure of the first train specified in the e-ticket for which the Insurance Contract (insurance policy) has been issued. No additional documents will be executed by the parties. The contract of Insurance (insurance policy) will be terminated by reason of terminating the relevant contract of carriage. The Contract of Insurance (insurance policy) will be terminated with a full refund of the insurance premium. The insurance premium will be refunded to the bank card account from which the insurance premium has been paid upon termination of the Contract of Insurance (insurance policy) using JSC RZHD's web portal.

The insurance premium to be refunded for the early terminated contract of insurance (insurance policy) will be credited in full to the bank card account from which the insurance contract (insurance policy) has been paid for within the time specified by the payment system rules (from 7 to 30 calendar days of the refund claim in the user profile). The refund to the bank card account from which payment has been made for both the e-ticket and the contract of insurance (insurance policy) will credited by separate payments.

If any disputes arise concerning refunds to be credited to your account, you should contact VTB 24 (PAO) by phone at 8-800-100-24-24, and also to the issuing bank where you are listed as a card holder.

2.3.2. The contract of insurance (insurance policy) issued for an e-ticket less than one (1) hour before the departure of the first train specified in the e-ticket to which the Contract of insurance (insurance policy) is attached may be terminated (canceled) and an e-ticket ticket obtained at the booking offices of JSC FPK may be returned only at the Insurer"s offices by a written application of the Policyholder (the Insured).

In this case an application to cancel the contract of insurance may be submitted by the Policyholder by delivering it to the Insurer (when the Policyholder appears at the Insurer's office) or by sending it through a mail service provider.

the contract of insurance will terminate:

  • on the date of the Insurer's receipt of a written application from the Policyholder to cancel the contract of insurance filed directly with the Insurer's office;
  • on the date of the Policyholder's submission of a written application to cancel the contract of insurance to a mail service provider to be dispatched to the Insurer.

The Insurer (its authorized representative) will refund an insurance premium not later than ten (10) business days of the delivery date of a respective written application of the Policyholder to cancel the contract of insurance.

When the Policyholder, an individual, chooses to cancel the contract of insurance upon expiration of the cooling-off period, if such period is provided, the paid insurance premium will not be refunded except for the events covered the Insurer's Special Terms and Conditions.
